What has changed?
The UK is committed to maintaining the high standards of the GDPR (General Data Protection Regulation) and the government has incorporated it into UK law as the UK GDPR, with effect from 1 January 2021.
Who does UKGDPR apply to?
The UKGDPR applies to ‘controllers’ and ‘processors’. The definitions are broadly the same as GDPR although we are in a transition period for the next 6 months, and these obligations will fall away if an adequacy comes into force.
If you are a processor, the UKGDPR will place a greater liability on you if a breach occurs. Controllers have greater responsibility to ensure contract with processors are operated correctly.
The UKGDPR does not apply to certain activities including;
- Processing covered by the Law Enforcement Directive.
- Processing for National Security purposes.
- Processing carried out by individuals purely for personal or household activities.
